Terms and conditions
These are our terms and conditions. These, together with the references they contain, apply to every agreement that we, MTD Retail BV, trade name: de winkel van nijntje, Chamber of Commerce number: 34198645, conclude with you. If you have any questions, please do not hesitate to contact us via [email protected] or by post: MTD Retail BV, Scheldestraat 61, 1078 GH Amsterdam (NL). We have the right to change these terms and conditions. You agree that the latest version of these terms and conditions will always apply to our agreement.
Article 1 – Products
We sell various (miffy) products. The changing range includes: cuddly toys, books, toys, crockery, hair accessories, (room) decoration, bags, cards and clothing.
Article 2 – Registration
You must register to order a product. You must provide us with your personal information for this. You must fill in this personal information truthfully and it must be up to date. We protect your personal data well; see also our Privacy Statement on our website. Use a strong password for your account and never give your password to others. You are responsible for any misuse of your account (for example: if someone else places an order with us using your password).
Article 3 – Payments
The (total) price of the products is stated in our webshop. The prices stated for the products and services offered are in euros, including VAT and excluding handling and shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing. You can pay in our webshop with iDeal or credit card. If you are in default with any payment, Miffy's shop is entitled to suspend or dissolve (the execution of) the agreement in question and related agreements.
Article 4 – Deliveries / Click & Collect
Your order will be processed immediately as soon as we have received the payment. You will receive the confirmation of the placed order by e-mail. You will also receive an e-mail from us once the order has been shipped. It is possible that these emails end up in the spam folder. We do our best to ship / prepare the order for pick-up in the store within 7 working days. In the unlikely event that this does not work, you can request us to (a) immediately refund the amount you paid for the product or (b) send a replacement product (of equal value). If the order is delayed, we will notify you.
When you have completed an order with us and have opted for pick-up in the store, you have a maximum of 4 weeks to pick up the order. Otherwise we will credit the amount.
Article 5 – Return
You may always return the product within 14 days after you have received it (the product must be unused). You can do this by sending an email to [email protected]. After you have received a confirmation from us, you must send the product within 14 days. Once we have received the product, we will refund the full purchase amount within 7 days. The costs for the return shipment are for your account. Are all items in your order returned? Then we will also credit any shipping costs charged. During the period you have to consider whether you want to keep the product, you must handle the product and the packaging with care. You may only unpack and open the product to the extent necessary to determine whether you wish to keep the product.
In the event of breakage or shortage (number of items received is less than on the packing slip), we will send you the relevant items as soon as possible, of course without shipping costs. If you still encounter complaints after using the product, please let us know as soon as possible. We will look for a suitable solution in consultation.

Article 6 – Liability
We are not liable for damage caused by the use of a product. This does not apply if that damage is caused by our intent, gross negligence or willful recklessness. Your right to compensation will in any case not exceed the amount of the product ordered and paid for.
Article 7 – Intellectual property rights
All intellectual property rights (such as: copyrights, logos, word marks) on our texts, photos, images and other materials are our property (or are managed by us with the permission of the owner). Your use must not infringe this.
Article 8 – Complaints procedure
If you have a complaint about the implementation of the agreement, we would like to hear from you. You can send your complaint by email (described as quickly and as fully as possible) to [email protected]. We will process your complaint as soon as possible, at the latest within 3 working days after we have received your complaint. If it takes longer to settle the complaint, you will receive a confirmation of your complaint within 3 working days and we will let you know when we expect a substantive answer. If we are unable to resolve the complaint between ourselves, a dispute will arise that falls under the dispute settlement procedure.
Article 9 – Dispute settlement
These general terms and conditions and the agreements that we conclude with you are exclusively governed by Dutch law.
